In this interesting case from County Durham, a local resident Mr Ian Galloway brought judicial review proceedings contending that the planning permission had either authorised a solar farm capable of producing energy above the 50MW limit (being the maximum size that can be considered by local planning authorities) or one with grossly inefficient panels.
For the first time a light has been shone on a key aspect of these schemes - namely whether the actual performance potential of the scheme applied for is considerably higher than that which is given as the “nameplate” figure during the consultation process. This begs the question as to whether excessive amounts of agricultural land and landscape is being affected by these schemes large or small. In short, are these schemes capable of containment within a smaller footprint and is the oversizing principally to the advantage of the developer who knows the performance of the panels ultimately installed (and replaced from time to time during the life of the scheme) is only going to improve? This case is on point with Stonestreet Green since Evolution Power have stated throughout the consultation process that the capacity of their proposed scheme was up to 99.9MW when, in conjunction with 31 battery units, it is actually capable of 165MW – or more.
